neighborhoods in the city. we have enjoyed a very lucky vote past november where our paving and streets -- that will produce $240 million of anchor for our streets repaving but also for infrastructure in our streets that allow you need to move faster, less congested, our curb ramps for persons with disabilities, a number of street park with that will be had. bike lanes that will allow our bikers -- a lot of them want to be able to have dedicated green lanes. all of that has anchored into a very strong vote, one that was very difficult to pass because it required 2/3, and we were able to do that. very fortunate in our city to be able to have that. and, of course, improving our public transportation. muni continues to be a challenge because of its infrastructure and its debts, and we will continue paying attention to that, and that is why we have got to be always investing in our future, and transportation is a huge part of that, but we have been very successful in gaining federal grants for that in the past, but also making sure we can build infrastructures like the central subway that a

jose. also in the process we have been coordinating with the cities of oakland and san jose and a big transportation providers, we knew that the big three cities there is leadership in this process; if we were not okay with what was proposed, we have to make surethat we have a voice. a lot of this in san jose. >> unlike san francisco, in san jose most of the job centers are not within the downtown area opposite of what the situation is. , it makes that most difficult it explains why it is that way and why we have low projections in places like contra costa, low, even though the population is much larger than that of san francisco county and san mateo county which is slightly less. i can understand. at least contra costa has more transit than even the south bay does. my other question for-- in terms of transportation-- and you can answer this is probably not. what i am interested in, i have always tried to figure out exactly what kind of planning goes into transportation; it seems like it moves slowly, with no guiding idea at the end of that make sense. san francisco is a small city g

records of any kind relating to discussions with any other agencies. the references to the san jose city attorney's office are dated 9 months after that. but i think what is really important is that there is a, i think, a reference in an e-mail that it was mr. st craw who spoke to the city attorney about taking these cases. so what we don't know is how this magically happened, nine months later. there are also no e-mails or other written communications of any kind internally within the staff or with any of the commissioners with one exception which i will give you in a moment. so there is no way to track how this all came about. >> it is obvious that none of you were directly involved in the decision, which considering that it involved your... it had to be completely transparent and it had to be one that everybody would accept. i did find an e-mail from the chairman. it surprised me. it said, it went to mr. san croy. read shaw's complaints is there not any reason that we can't release san jose's analysis about why st san croy's allegations fall. i don't know much about ethics but i know

is keeping them out because the city attorney says you can. in the task force case 11088, which ethics commission was found in violation of the ordinance, to date this commission has refused to comply and refused to hear the referal from sotf from ethics, of course what you produced is 134-page response trying to justify it which is a load of crap. why are you so afraid of having comments from the public be presented accurately in the official records of your meetings. why do you insist on placing the 150 word summaries in an alternative location, substituting in their proper place, in the minutes, your sensored version of those comments? and why have the members of the ethics commission advocated their responsibility to the director john saint croy in matters that go to the very heart of the open and honest operation. it is a real shame that a citizen of this city has to actually fight with boards and commissions who have taken an oath to support and defend the constitution of the united states and that of the state of california, who in some cases even have a chance to speak. and thi

and elsewhere in the city? >> i think the bay area has a group of anarchists. with the oakland occupiers, two years ago, we had the bank demonstrations in san francisco. i think it is a very similar group. you had a lot of broken windows and demonstrations. everybody was wondering if -- this was after seattle, the international monetary fund meeting. everyone wondered if they would leave there. they came over and seemed to hang out in oakland for a while. i think we have a particular political element in the bay area that other people do not have. people in oakland -- that is the difference. i do not think it is fair to call that the whole occupy movement. there is a general sense in the world and the u.s. that there should be more income equality. there is a broad group of people in oakland -- i think that was one of the hard things for me as mayor, to get the city to have consensus on it, because people were very sensitive to that. there is taxing oil companies, etc.. that is not unique to oakland. occupy in the fall began to fall away to different groupings. you had groupings that would be

alleging that a city officer or employee has engaged in improper activity by, again, violating campaign finance lobbying, conflicts of interest, or government ethics laws, regulations. the difference between them is that the complaints can be filed under 4.105 a. alleging many different violations of improper activities but under 4.105 d, not all of them are investigated pursuant to procedures in c3699-13. so the whole thing in my opinion is moot. . i believe that miss herrick, may have also have wrongly claimed that the california evidence code 1040, and its definition of official information, may have been misquoted and she may have incorrectly relied on deputy city attorney improper letter to the sunshine ordinance task force in which he wrongly combined two or three of dr. derek kurr's complaints under one ball of wax wrongly. he made a mistake when he did that. in section 1040 is not whether disclosure is permitted, it is whether disclosure is forbidden. jerry made that lettering error. how a deputy city attorney can confound forbidden can permitted and then, deputy city attorney

do find it meaningful that the city attorney reminds us that we have no legal conflict either individually or collectively. i have no obligation to the executive director, the executive director obligation is to the commission as a group and to the city and county, not personal. i can understand why we don't have staff to investigate their supervisor, that makes complete sense. so in trying to... i just want you to create a window where we didn't just rush to do something that thoughtful people were flagging for. but as we were trying to construct it, as a question of legal conflict and of our confidence to do it and our responsibility to do it, which is the other part mr. gibner raised. there is the past practice, the past example involving the deputy director, where we did seek counsel from others so that it would not be a staff colleague doing the investigation, but this body handled it. and i quite honestly can't remember if i was on at that time, and if so, whether we analyzed this, i came on in 07, probably not in time for that item. and i think that it is fair for peopl
